APOGEETerms of Service
Last updated: October 24, 2026
Welcome to Apogee. These Terms of Service ("Terms") are a legal agreement between you and Apogee Athlete LLC ("Apogee," "we," "us"). They cover your use of the Apogee app and any related websites and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
PLEASE READ SECTION 20 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION, UNLESS YOU OPT OUT.
1. Who Can Use Apogee
- You must be at least 14 years old to use Apogee.
- If you're under 18 (or the age of majority where you live), you may use Apogee only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. If you're 14 or 15, we ask for a parent or guardian's email when you sign up and send them a link to review and approve your account. Until they approve, you can browse, but you can't post, comment, message, or be found in search. We keep a record of the approval (when it was given, the parent's email, and the version they agreed to). If you're 16 or 17, you don't need to complete that step in the app, but by using Apogee you confirm that your parent or guardian has agreed to these Terms for you.
- All teen accounts (ages 14 to 17) also have these protections: your profile starts private; you appear only on country and world leaderboards, by username only, without your gym, location, or name, and never on gym or local leaderboards; you can message other teens who follow you and whom you follow back; you and an adult (18 or older) can message each other only after your parent or guardian approves that adult; you aren't shown to adults in suggested accounts or nearby features; you can take the Natural Oath and compete on the Natural boards, and you're never drug tested while you're under 18 (from 18 you can be selected for random testing like any adult); you can boost your profile, but a teen's boost is shown only to other teens (14 to 17), never to adults, and posts can't be boosted; if you're 14 or 15, ID verification is available only after a parent approves; and we don't send push notifications from 10pm to 7am your local time. Parent approval stops being required at 16, and the other limits end automatically when you turn 18. We'll let you know.
- You can't use Apogee if we've previously banned you, or if you're barred from using it under the laws of the United States or where you live.
- Apogee is currently intended for users competing in the United States.
- The Service is currently offered only in the United States and is intended for users located in the United States. We don't claim it's appropriate or available for use anywhere else. If you use it from outside the United States, you do so on your own initiative and are responsible for following the laws where you are.
2. Your Account
- Give us accurate information when you sign up and keep it up to date, including your sex, date of birth, weight, gym, school, and county. Leaderboards depend on it.
- Your username is permanent and can't be changed.
- Keep your login private. You're responsible for everything that happens on your account. Tell us right away at support@apogeeathlete.com if you think someone else has accessed it.
- One person, one account. Don't create accounts for someone else, share accounts, or buy, sell, or transfer accounts.
3. What Apogee Is
Apogee is a fitness community where you record proof of your lifts, runs, and other performances, have them reviewed, and see where you rank against others by gym, school, county, state, and country. Apogee also includes a social feed, check-ins, messaging, comments, sounds, and a scroll-time system that rewards productive habits. We may add, change, or remove features at any time.
4. Verified Lifts and Verification
- Submissions. Anything you submit for verification must be your own real performance. Video and photo proof must be honest and unedited in any way that changes the result. AI-generated, sped-up, staged, borrowed, or doctored proof, and fake or mislabeled weights, are not allowed.
- Competition results. Where offered, we may accept photos of official competition results from the last 12 months, along with proof of your bodyweight from within 30 days of the competition. These are accepted on an honor system and may be rejected at our discretion.
- Weigh-ins. Verified lifts may require a weigh-in photo to confirm your weight class.
- Posting limits. You get 2 free approved verified lifts each calendar month; it resets on the 1st, and a lift counts in the month it's approved (pending or denied ones don't). After that, posting a verified lift requires a minimum amount of saved scroll time (currently 2 hours 50 minutes; nothing is deducted), or a paid option when it's offered. We may change these limits at any time.
- Review. Our team decides whether to approve, reject, or later remove any submission, for any reason, including suspected dishonesty. Approval is not a guarantee that a result is accurate and is not an official record recognized by any sanctioning body.
- ID verification. ID checks are handled by a third-party identity provider (currently Didit). Your ID images and selfie go to that provider under its own terms and privacy policy; we receive only the result, your confirmed birthdate and sex (when your ID shows it), and the name on your ID (used to check the name you swear the Natural Oath under).
- Natural track. Competing on the Natural boards means taking the Natural Oath, your own declaration that you compete natural. Taking the oath shows the Natural badge on your profile. Natural status, and the badge, can be withdrawn or revoked if we believe you've broken the oath, including after a failed, refused or missed drug test. Apogee does not provide medical testing, advice, or diagnosis.
- Military category. The Military category is not affiliated with or endorsed by the Department of Defense or any branch of the U.S. Armed Forces. Scores here are not official records. Never submit a photo of a CAC or military ID.
5. Leaderboards and Apogee Rating
Leaderboards, rankings, and your Apogee Rating are features we provide for fun and motivation. We may change how they're calculated, recalculate them, correct errors, or remove entries at any time. You can hide yourself from public leaderboards in Privacy settings; you'll still see your own ranking. Rankings, ratings, badges, and stamps have no cash value and give you no rights beyond using them in the app.
6. Scroll Time, Productivity Check-Ins, and Community Votes
- Scroll time. Apogee limits how long you can scroll other people's content. You earn more time by posting productivity check-ins that other users confirm. Balances are capped (currently at 3 hours) and can go negative (currently down to minus 30 minutes). You can move earned time (time above the free daily allowance) into your Time Bank; banked time is permanent, has no cash or other value, and can't be spent, withdrawn, or transferred. The free daily allowance can't be banked, and it's always used before earned time. Posting a verified lift doesn't deduct time. We may change the amounts, caps, and rules at any time.
- Check-in challenges. A mutual follower can challenge an approved productivity check-in once by staking scroll time equal to its reward. Other mutual followers then vote, for free, on whether it's legit; the first side to two votes decides it, and a challenge with no verdict when the check-in expires counts as legit. If it's voted not legit, the poster loses twice the reward, the approver loses the reward, and the challenger gets their stake back plus the same amount; otherwise the challenger loses their stake. Deleting a check-in while it's challenged counts as not legit. Challengers and voters are kept anonymous. Balances stay within the cap and the minimum above. Don't coordinate challenges or votes; we may reverse results and adjust balances to stop abuse.
- Community votes. You can spend your own scroll time to vote on other users' comments. A vote up gives that user time; a vote down costs you more time than it takes from them. Votes are final once confirmed and are not refunded if a comment is later edited or deleted. Down-voters are kept anonymous; up-voters may be named.
- Community removal. A comment may be removed automatically if community votes push its author to the minimum balance. We may also restore, remove, or adjust any comment, vote, or balance at our discretion, including to stop abuse, coordinated voting, or use of multiple accounts.
- No value. Scroll time, votes, and similar features have no monetary value, can't be bought, sold, transferred outside the app, or exchanged for anything of value, and are not your property. We may reset or remove them at any time, including when an account is suspended or closed.
7. Your Content
- You own it. You keep ownership of the videos, photos, captions, comments, messages, sounds, and other content you post ("Your Content").
- License to us. You give Apogee a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, perform, adapt (for example, to resize or format it), and distribute Your Content to operate, improve, and promote the Service. This license ends when you delete Your Content or your account, except: (a) where others have already reposted, saved, or used it as allowed in the app (for example, a sound used in someone else's post); (b) where we're required to keep it for legal reasons; and (c) for reasonable backup copies kept for a limited time.
- Sounds. If you make a sound available, other users may use it in their own posts as the app allows.
- Your responsibility. You're responsible for Your Content. You promise you have the rights to post it, that it doesn't violate anyone's rights (including copyright, publicity, and privacy rights) or any law, and that anyone identifiable in it agreed to be included.
- Comments. Comments you post may be edited or deleted by you, but votes they've received still count.
8. Rules of Conduct
You agree not to:
- Harass, bully, threaten, or target anyone, or post hate speech or content that promotes violence or self-harm.
- Post sexual content involving minors (we report it to authorities), sexually explicit content, or graphic violence.
- Cheat: submit false proof, misrepresent your sex, age, weight, gym, or status, use multiple accounts, or coordinate votes or check-in confirmations.
- Impersonate anyone, or misrepresent your connection to any person, gym, school, or organization.
- Spam, advertise, or solicit without our permission.
- Post content you don't have the rights to, or anyone's private information.
- Promote or sell illegal drugs, steroids, or other controlled substances.
- Scrape, crawl, or collect data from the Service; reverse engineer it; interfere with its security; or access it through anything other than the app and tools we provide.
- Use the Service to break any law.
Our Community Guidelines, available in the app, are part of these Terms.
We have zero tolerance for objectionable content or abusive users. Anyone can report content or an account from the app; we review reports and act on them, which can include removing content and suspending or banning accounts.
9. Reporting, Moderation, and Enforcement
- You can report content and accounts in the app. We review reports and act on objectionable content, typically within 24 hours.
- Child safety: to report anything sexual involving a minor, or an adult pressuring a teen, use Report in the app and email safety@apogeeathlete.com. If a child is in immediate danger, call 911.
- We may remove content, reject or revoke verifications, remove leaderboard entries, reset scroll time, limit features, suspend, or permanently ban accounts, with or without notice, if we believe someone has broken these Terms or the law, or to protect users or Apogee.
- If we ban an account, we may keep identifiers linked to it (such as the email address and Apple ID) to prevent the same person from returning, as described in our Privacy Policy.
- We're not obligated to monitor content, and we're not responsible for content posted by users.
10. Blocking, Messaging, and Privacy Controls
You can block other users, choose who can message you, and make your account private. Blocking stops a user from seeing your profile and posts and from messaging you. These tools help, but they can't guarantee that no one ever sees your public content (for example, through screenshots).
11. Health and Safety
- Exercise carries a risk of serious injury or death. You are solely responsible for deciding whether an activity is safe for you, using proper form and equipment, warming up, and using a spotter where appropriate. Consult a doctor before starting any training program.
- Apogee doesn't provide medical, nutrition, or training advice. Form tips and instructions in the app are general information only.
- Never risk your safety, or anyone else's, to record a lift or chase a ranking.
- TO THE FULLEST EXTENT ALLOWED BY LAW, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, OR DEATH ARISING FROM ANY ACTIVITY YOU PERFORM IN CONNECTION WITH THE SERVICE.
12. Third-Party Services
Apogee relies on third parties (for example, Apple, Google, Didit, Supabase, Resend, and map and places providers; our Privacy Policy lists them all). Your use of their services may be governed by their own terms and privacy policies. We're not responsible for third-party services, websites, or content.
13. Apogee's Intellectual Property
The Service, including the Apogee name, logo, winged "A" mark, design, software, and content we create, belongs to Apogee and its licensors and is protected by law. We give you a personal, limited, revocable, non-transferable, non-exclusive license to use the app for its intended purpose, subject to these Terms. If you send us feedback or ideas, we may use them without any obligation to you.
14. Copyright (DMCA) Takedowns
We respect copyright and respond to notices under the Digital Millennium Copyright Act (DMCA).
- Quick report. You can flag a post with "Report copyright" in its report menu. That alerts our team, but a formal takedown needs the written notice below.
- How to send a notice. Email our designated copyright agent at legal@apogeeathlete.com. Your notice must include:
- your physical or electronic signature;
- a description of the copyrighted work you say is infringed;
- where the material is in Apogee (the username and a link or description of the post) so we can find it;
- your name, address, phone number, and email;
- a statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you're the owner or authorized to act for the owner.
- What we do. When we receive a valid notice, we remove or disable access to the material promptly and let the person who posted it know.
- Counter-notice. If your content was removed and you believe it was a mistake or misidentification, you can send a counter-notice to legal@apogeeathlete.com with: your physical or electronic signature; a description of the removed material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; and your name, address, and phone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the U.S., any judicial district where Apogee may be found) and will accept service of process from the person who sent the notice. We'll forward it to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they've filed a court action, we may restore the material.
- Misrepresentations. Anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. ยง 512(f).
- Repeat infringers. We keep track of valid notices. Accounts that receive repeated valid notices will be terminated in appropriate circumstances.
15. Privacy
Our Privacy Policy and Verification Data & Privacy notice explain what we collect and how we use it, including sensitive information like ID results. Both are available in Settings and are part of these Terms.
16. Ending Your Use
You can stop using Apogee or delete your account at any time in Settings. A deleted account is hidden right away and permanently deleted after 30 days; logging back in before then restores it. We may suspend or end your access as described in Section 9, or if we stop offering the Service. Sections that by their nature should survive (including 7's license limits, and 11 and 17 through 24) survive termination.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, APOGEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT RANKINGS OR VERIFICATIONS ARE ACCURATE, OR THAT CONTENT OR DATA WON'T BE LOST.
18. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, APOGEE AND ITS OWNERS, EMPLOYEES, AND PARTNERS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR RANKINGS, OR FOR ANY PERSONAL INJURY ARISING FROM YOUR PHYSICAL ACTIVITY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WON'T EXCEED THE GREATER OF $100 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME PLACES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.
19. Indemnification
You agree to defend, indemnify, and hold Apogee harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your physical activities, or your breach of these Terms or the law.
20. Disputes and Arbitration
- Talk to us first. Before filing any claim, contact us at legal@apogeeathlete.com and give us 60 days to try to resolve it informally.
- Binding arbitration. If we can't resolve it, you and Apogee agree that any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies.
- No class actions. YOU AND APOGEE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
- Opt out. You can opt out of this arbitration agreement by emailing legal@apogeeathlete.com within 30 days of first accepting these Terms, with your username and a clear statement that you opt out.
- Exceptions. Either party may go to court to stop infringement or misuse of intellectual property.
- Minors.
- Mass arbitration. If 25 or more similar demands are filed by the same or coordinated counsel, they may be administered in batches under the provider's mass-arbitration rules.
- Severability. If the class-action waiver is found unenforceable for a claim, that claim (and only that claim) proceeds in court, and the rest of this section still applies.
21. Governing Law
These Terms are written for users in the United States and under United States law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to Section 20, any court proceedings will take place in the state or federal courts located in San Diego County, California, and you and Apogee consent to their jurisdiction.
22. Apple App Store Terms
If you downloaded Apogee from Apple's App Store:
- These Terms are between you and Apogee only, not Apple. Apogee, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apogee, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- Apogee, not Apple, is responsible for investigating, defending, settling, and discharging any third-party claim that the app infringes intellectual property rights.
- You confirm you're not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you're not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
23. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll let you know in the app or by email before they take effect. Continuing to use Apogee after changes take effect means you accept the updated Terms.
24. General
These Terms, with the documents they reference, are the entire agreement between you and Apogee about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You can't transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, employment, or agency relationship.
